Due to the COVID-19 outbreak, the 2020 social elections did not take place in May of this year. On 23 April 2020, the Chamber of Representatives approved the Act to postpone the social elections, effectively suspending the procedure after date X+35 (normally situated between 17 and 30 March 2020). For more information on the suspension of the 2020 social elections, we refer to our newsletter on this topic.
A Royal Decree of 15 July 2020 determined that the social elections will instead be organised during the period from 16 November 2020 up until and including 29 November 2020. The social elections proceedings will be rebooted as from date X+36, which is situated between 23 September 2020 and 6 October 2020, depending on the chosen election date.
We've adjusted our calendar tool accordingly and to generate your timeline for the reboot of the social elections proceedings (from date X+36), refer to the correlation table below and select the COVID-19 election date that corresponds to the election date you initially chose.
To view a more tailored timeline, you can select the normal days of inactivity in your company. If one of the procedure’s deadlines falls on a Sunday, legal holiday or normal day of inactivity in your company, the deadline will move to the preceding workday. If you select the normal days of inactivity in your company, the generated timeline will take this into account and will automatically show you the adjusted deadlines. When calculating your tailor-made timeline, we only take into account legal holidays. Possible industry-level holidays or company-level (replacement) holidays aren’t factored in.
Pay attention: if your company is closed on Saturday and Sunday, choosing a Thursday or Friday to hold your social elections might result in organisational challenges. Indeed, in such a scenario, the election itself, the closure of the election and the posting of the election results and of the new composition of the representative bodies will all have to take place on 1 or 2 days.
