2 months ago, we provided our first insights on the draft act on unfair contractual terms in B2B contracts. As we promised to keep you posted, we are happy to announce that act has been published in the Belgian Official Gazette on 24 May 2019.
The new regime will therefore enter into force on 1 December 2020, applying to new contracts or existing contracts that will be entered into, renewed or modified after that date.
Revisiting your B2B general terms & conditions and template agreements from this new angle will definitely be required in order to avoid clauses being challenged and declared null and void in court.
