Social inspections

Do you know what to do when an inspector calls?

Social inspections often take companies unawares, and many employers don’t realise that a failed inspection can result in criminal sanctions, fines and reputational damage. Given the complex nature of Belgian social law, there are many social inspectorates and it can be unclear to employers which inspectorate is coming. Too often employers find themselves lost in the document requirements, giving away information unnecessarily, and putting their company at risk of litigation or fines.

Who is at risk of an inspection?

Any company can be the target of an inspection. Inspectorates use coordinated data mining techniques across different services to identify companies considered at risk for non-compliance with social and labour laws. Inspections can also occur as a matter of routine, or at the initiative of a particular inspectorate based on a complaint.

Which areas of social and labour law fall under social inspections?

Social inspections can audit many areas of social and labour law, causing confusion among employers. Employers often mistakenly think inspections will be a walk in the park, not realising the serious implications if they are found to be in breach of the law. Social inspections check compliance in areas such as employment, wellbeing, sickness and invalidity and social security. Inspections are carried out by both national and regional bodies and can even be organised at a European level.
